Terms & Conditions
1. INTERPRETATION AND VARIATION
1.1 In the Terms and Conditions the following definitions apply: "Company" means Absolute Pilates Plus Limited, trading as ‘Absolute Studios’ and/or OTE Health and Fitness Ltd, trading as ‘Absolute Studios Kensal Rise’. "Client'' means any person that has completed and submitted the online registration form (the "Registration Form") at the Absolute Studios website www.absolute-studios.co.uk, and which registration has been accepted by the Company or any person that has purchased a PAYG class pack. "Member'' means any person that has purchased a monthly membership and has been accepted by the Company. "Studio" means the Absolute Pilates Plus Limited studio at Unit G 19 Heathman’s Road London SW6 4TJ and/or OTE Health and Fitness Ltd , 77A College Road, Kensal Rise, London, NW10 5ES."Terms and Conditions" means these terms and conditions.
1.2 References in the Terms and Conditions to the singular will include the plural and vice versa and references to the masculine gender will include references to the feminine and other genders.
1.3 The Terms and Conditions are incorporated into the Registration Form.
1.4 The Company reserves the right to vary and revoke the Terms and Conditions from time to time which variation it may consider necessary or desirable for the regulation of the affairs of the Studio and the conduct of Members/Clients. Any such changes will be notified to Members/Clients and, until revoked, are and will be binding on Members/Clients.
1.5 The Terms and Conditions will be governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
2. MEMBERSHIP
2.1 Subject to condition 2.2, when a person has completed the Registration Form, they will become a Client of the Studio.
2.2 There are two client types at the studio that qualify for different benefits.
- Pay as You Go (PAYG) clients
This is any Client who has paid for a PAYG pack and has visited the studio within the last 6-months.
This client type is not eligible for Members only promotions and incentives.
- Pay Monthly (Membership subscribed) Members
You will be subscribed to any of our rolling membership class packages.
This membership type is eligible for members only promotions and incentives.
2.3 Acceptance of a person as a Member/Client is in the absolute discretion of the Company.
2.4 The Company reserves the right to expel from the Studio, suspend for a specific period or refuse to renew the membership of any Member whose conduct is or may, in the Company's reasonable opinion, be injurious to the character of the Studio or which amounts to a breach of the Terms and Conditions or where such expulsion is otherwise in the interests of the other Members/Clients of the Studio. Any Member so expelled will forthwith cease to be a Member of the Studio and will not be entitled to any refund for any period during which his membership is suspended.
2.5 If a Member/Client brings a guest to the Studio for a class that guest must before the commencement of the relevant class become a Client in accordance with and subject to the Terms and Conditions.
2.6 Monthly Memberships are unable to be put on hold/paused unless they fall under extenuating circumstances (injuries, pre/post natal, out of the country for 3+ months at a time)
3. STUDIO OPENING TIMES
3.1 Details of class times at the Studio may vary from time to time. Class times will be published by the Studio and will be available either at the Studio or www.absolute-studios.co.uk. Class timetables may also be available through third parties such as Momence, Classpass or Gym Pass, however, The Company takes no responsibility for ensuring that information from these parties is accurate and up-to-date.
4. PAYMENT TERMS
4.1 Details of class prices and gift card prices are available either at www.absolute-studios.co.uk or directly from the Studio and will be such prices as determined by the Company from time to time.
4.2 A Member/Client may not attend any session at the Studio without first booking and paying for the relevant session unless there are any special promotions which state otherwise.
4.3 Payments for classes and gift cards in any amount are non-refundable unless otherwise stated in the Terms and Conditions.
4.4 Classes are valid for different time periods, subject to the terms of the class package at the time of purchase. The Company reserves the right to change these terms from time to time with reasonable notice. All classes must be used within that period. Unused classes will not be eligible for a refund or transfer of any kind.
4.5 PAYG Terms:
5x class PAYG packs are valid for 2-months from the date of purchase.
10x class PAYG packs are valid for 3-months from the date of purchase.
20x class PAYG packs are valid for 6-months from the date of purchase.
4.6 Membership Terms
All membership types will have some classes available to the member to use each month. The number of classes are fixed, and as a general rule will not be carried over into the next month, any deviation from this will be solely at the discretion of the company.
This is a monthly rolling contract with a minimum 2 month period but no fixed term. If you wish to cancel, you must provide a 30 day written notice via email. Your payment will be automatically direct-debited from your nominated account / card on the same date each month.
4.7 All Members/Clients (either PAYG or Monthly) will be able to book a maximum of 1 reformer Pilates classes per day.
5. BOOKINGS AND CANCELLATIONS
5.1 Class bookings can be cancelled up to 12 hours before the start time
Any cancellation giving less than 12 hours’ notice is classed as a late cancellation (unless there are extenuating circumstances, in which case please contact the studio directly). A late cancellation means the class credit will be lost for that month.
5.2 Classes are booked on a first-come-first-served basis.
5.3 New Members/Clients or any Members/Clients who have not participated in a reformer Pilates class at Absolute Studios for at least 6-months must book and participate in a Beginners Pilates class before enrolling on any of the Intermediate or Advanced classes. This also applies to anybody who is post-natal or recovering from injury.
5.4 New Clients must sign and agree to our Liability Release at the point of Sign Up (Registration) before taking part in the class
5.5 If we cancel your Booking
If we cancel a class or classes that you have booked, we will contact you by e-mail or telephone and offer you the choice of:
1. Having the class returned to your package
2. The booking being transferred to an alternative date and time.
5.6 Clients with Special Needs
If you have special needs, we ask that you advise us of your requirements by telephone before you make a booking online.
You can help us ensure we will be able to meet your needs by contacting us at least 48 hours in advance of the date and time of the first class you wish to book.
5.7 Arriving on Time
Please ensure you arrive on time for your class. The pre-class warm-up is designed to help with the avoidance of injury. If you are more than 5 minutes late, the trainer has the right to refuse you entry into the class, and you will forfeit your credit. If you are more than 5 minutes late, we are not allowed to let you into class on the grounds of Health & Safety, and you will forfeit your credit.
New members should arrive at the studio no later than 10 minutes before the start of the session to familiarise themselves with the facilities and equipment.
Note: Wait-list clients sometimes show up in the hope of getting a late space in class. If you are 5 minutes or later, then we will give your space to any waiting clients.
5.8 Bookings Liability
A binding contract is not formed until we accept your offer to make a booking for a class or block of classes. An offer will be deemed to have been accepted by us once you receive a booking confirmation from us.
Prices are subject to change at any time by us before we accept your booking.
All classes are offered by us subject to availability.
Notwithstanding the foregoing, in the event of a genuine website error or inaccuracy, we reserve the right to cancel all confirmed class bookings. In the event of such cancellation, our only liability to you shall be to refund the price paid by you for your class booking, or to transfer you to a class at an alternative date and time, whichever you prefer.
6. FITNESS AND HEALTH
6.1 Members/Clients are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Studio reserves the right to refuse access to any Member(s)/Client(s) if, in its absolute discretion, it considers that the use of such facilities may endanger the health of the individual concerned.
6.2 Members/Clients with low/high blood pressure and/or cardiac irregularities should not attend class. If there is any doubt, the Member/Client should consult their doctor. Members/Clients must notify the Studio of any circumstances affecting their health which may be exacerbated by continued use of the Studio.
6.3 Members are required to follow the instructions of the instructor at all times.
7. LIMITATION OF LIABILITY
7.1 The Company cannot be held responsible for any particular class, instructor and/or item of Pilates or other equipment not being available for whatever reason. The Company reserves the right to make alterations to the classes, instructors and/or equipment, as well as to those ancillary facilities (e.g. showers), provided to Members/Clients, without notice and in its absolute discretion and the Company will not be liable for any loss occasioned by such alterations except insofar as such loss is by law incapable of exclusion.
7.2 It is the Members/Clients responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme which they follow or class which they attend. Members accept the risk of injury from performing exercises and are advised to consult their doctor before beginning any session.
7.3 The Company accepts no liability for loss or damage to property of Members/Clients or injury to Members/Clients on the Studio premises or outside the Studio except insofar as such loss, damage or injury is by law incapable of exclusion.
8. USE OF FACILITIES
8.1 A Member/Client is entitled to use the Studio's facilities provided always that the Studio may at any time without notice withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond the control of the Studio or the Company.
8.2 Children under the age of 18 are not permitted to use the studio for fitness activities.
8.3 Children over the age of 7 may not enter changing rooms or other areas reserved for the opposite sex, regardless of whether an adult accompanies them.
9. PERSONAL BELONGINGS
9.1 Personal belongings are brought onto the Studio premises at the Members/Clients own risk, and the Company does not accept liability for any loss or damage whatsoever to such items.
10. SAFETY & HYGIENE
10.1 In the interests of safety and hygiene, no crockery, glass or food is permitted in the changing rooms or training rooms. Only water is allowed within the Studio, or isotonic sports drink. Members/Clients are not allowed to bring alcohol into the studio in any circumstance. Other than guide dogs, no pets are permitted in the Studio buildings or grounds.
10.2 Notwithstanding paragraph 10.1 above, Members/Clients must not walk around the Fitness Studio barefoot if they have verrucas or similar foot complaints. Members should be wearing appropriate footwear around all other areas. Members/Clients must wear socks when taking part in classes and private sessions.
10.3 Members/Clients must use the main entrance to the Studio when entering or leaving the Studio. Fire exits, which are marked, are there in the interests of safety and Members must not interfere with these exits for any reason. In the event of a fire, Members/Clients are asked to make their way to the nearest available exit.
10.4 Smoking is forbidden in the Studio.
11. GENERAL
11.1 Members/Clients are required to give written notice to the Company of any change of personal details, including (but not limited to); name, address, telephone or email. Failing such notice, all communications will be assumed to have been received by the Member/Client within five days of mailing to the last address notified to the Company.
11.2 The Company reserves the right to refuse admission to the Studio.
11.3 The Company may assign the benefit of the Registration Process and a Member's membership to a third party at any time without notice to the Member.
11.4 A person who is not a party to the Registration Process has no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of the Registration Process.
11.5 The Company may, if a Member/Client, wishes to communicate with the Member/Client by electronic mail ("email"). By providing an email address to the Company, the Member/Client consents to receive email communications from the Company, including notices under the Terms and Conditions. The Member/Client also accepts the risk that email may not be a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with Members/Clients by email.
11.6 Members/Clients must at all times observe the Studio guidelines which may be notified to them from time to time and are requested to comply with any reasonable directions which the management of the Studio may issue to ensure the smooth operation of the Studio for the convenience of all Members.
11.7 Any marketing, educational or other materials of this nature whatsoever produced by the Company in connection with the Studio and which are made available to Members/Clients at the Studio will at all times remain the property of the Company and will be subject to the Company's copyright.
11.8 Website
We may update our website from time to time and may change the content at any time. However, please note that any of the content on our site may be out of date at any given time, and we are under no obligation to update it. Nor do we guarantee that our website, or any content on it, will be free from errors or omissions.
11.9 Accessing our site
Our site is made available free of charge.
We do not guarantee that our website, or any content on it, will always be available or be uninterrupted. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our website without notice. We will not be liable to you if for any reason our site is unavailable at any time or for any period.
You are responsible for making all arrangements necessary for you to have access to our website.
You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions and that they comply with them.
12. VOUCHERS AND PROMOTIONS
12.1 Intro Offer 3 for £30
This is valid for 21 days. Each member will receive 3 classes for the value of £30. Members may purchase this voucher for a friend. However, the friend must first register as a client of Absolute Studios online, through www.absolute-studios.co.uk.
Once a client, the 3 class credits will be allocated to that person’s account, which they can then go ahead and book through the online booking portal, or by contacting the studio reception, either in person, email or by telephone.
These classes must be used within 21 days of purchase

There is no cash alternative
